Travel Terms and Conditions for Luxterra Travel

These Terms and Conditions (“Terms”) govern the relationship between Luxterra Travel LLC (“Luxterra,” “we,” “us,” or “Agency”) and the traveler (“Client,” “you”). By booking or purchasing any travel services through Luxterra, the Client agrees to be legally bound by these Terms.

Luxterra Travel LLC acts solely as an intermediary between Clients and independent suppliers such as airlines, hotels, tour operators, cruise lines, ground transportation providers, travel insurance companies, and other travel-related service providers (“Suppliers”).

Luxterra does not own, operate, manage, or control any Suppliers and is not responsible for their acts, omissions, delays, or failure to provide services.

All travel services are subject to the Terms and Conditions of the applicable Suppliers.

2.1 Deposits & Payments

• Bookings may require a deposit or full payment at the time of booking.
   
• Prices are subject to change until confirmed by the Supplier.
   
• Payment authorizes Luxterra to purchase travel services and confirms acceptance of these Terms.
   

2.2 Client Review of Booking Details

Clients are responsible for reviewing all booking confirmations for accuracy and must report discrepancies within 24 hours.

2.3 Non-Refundable Agency Fees

• All agency, planning, research, and consultation fees are non-refundable unless stated otherwise in writing.
   
• Agency fees are separate from Supplier charges.
   

2.4 Credit Card Authorization & Chargebacks

• You authorize Luxterra to charge for travel arrangements and related fees.
   
• You agree not to initiate chargebacks except in cases of actual fraud.
   

Improper chargebacks may result in recovery of funds plus administrative, legal, and collection costs.

3.1 Supplier Policies

Cancellation and change policies vary by Supplier and are the Client’s responsibility to review.

3.2 Agency Service Fees

Luxterra may charge service fees for cancellations, changes, or rebookings.

3.3 Refunds

• Refunds are issued only according to Supplier policies.
   
• Some bookings are 100% non-refundable.
   

Luxterra strongly recommends comprehensive travel insurance. Clients who decline insurance do so at their own risk.

Clients are responsible for:

• Passports, visas, and required documentation
   
• Ensuring names match government-issued identification
   
• Compliance with government and Supplier requirements
   

Luxterra is not liable for denial of entry, deportation, or related costs.

Travel involves inherent risks. By booking, the Client voluntarily assumes all such risks.

7.1 Supplier Acts

Luxterra is not liable for Supplier acts, omissions, delays, or failures.

7.2 Force Majeure

Luxterra is not responsible for events beyond its control. Agency fees remain non-refundable.

7.3 Disclaimer of Warranties

All services are provided “as is” without warranties.

7.4 Liability Cap

Luxterra’s liability is limited to agency service fees paid.

Special requests are communicated to Suppliers but are not guaranteed.

Client information is used solely for travel planning and legal compliance.

These Terms may be updated at any time and are effective upon posting.

Payment or written authorization constitutes acceptance of these Terms.

All disputes shall be resolved through binding arbitration in Florida. Class actions are waived.

If any provision is unenforceable, the remaining provisions remain in effect.
